Firearms and Ammunition - As introduced, removes the offense of possessing a weapon in a building that prohibits or restricts weapons; allows a person with an enhanced handgun carry permit to carry a handgun into a business that prohibits or restricts weapons; removes penalties for violations of certain firearms provisions.

Present law provides that it is a Class B misdemeanor to possess a weapon in a building or on property that is properly posted in accordance with present law. Under present law, this Class B misdemeanor is punishable by a fine of $500. This bill deletes this provision entirely. Passage of this bill provides that:
  1. You are not breaking the law and there is no criminal penalty if you have an enhanced carry permit, and you use your firearm in self-defense on a property that may have postage signage restricting concealed carry.
  2. Private property rights still apply. If you are seen carrying and you are asked to leave the property, you must leave.
This is a step forward in protecting an individual’s right to self-defense and also working to lessen the impact of gun-free zones.
