Criminal Offenses - As introduced, increases the penalties for certain violations of the offense of unlawful photography; requires the court, rather than allowing the court discretion, to order a person convicted of certain unlawful photography offenses to register as a sexual offender; makes various other changes to the offense of unlawful photography.

If passed, this bill will increase penalties for those found guilty of “unlawful photography”, that is photographs taken of unclothed intimate areas without the knowledge or consent of the subject or the subject’s parent or guardian should the subject be a minor child, to disseminate the photos for intimidating, embarrassing or harassing the subject.
Should this bill be signed into law, a conviction of this offense would be a felony, and depending on the circumstances of the case, require compulsory participation in the sex offender registry.
Additionally, the law would be changed to categorize “unlawful photography” as a sexual offense.
