Education - As introduced, gives a parent of a child who attends, or who is eligible to attend, a school operated by a local education agency or a public charter school standing to file a civil action against the LEA or public charter school in a chancery court of competent jurisdiction to enforce the Age-Appropriate Materials Act of 2022.

If enacted, the proposed bill would grant parents of children who are enrolled in, or eligible to enroll in, schools governed by local education agencies or public charter schools the authority to initiate a civil lawsuit against said agencies or schools. This legal action would be to ensure adherence to the provisions of the Age-Appropriate Materials Act of 2022. Currently, the Act lacks a direct civil enforcement mechanism; however, the passage of this bill would provide parents with the legal standing to seek enforcement through the courts.
The Age-Appropriate Materials Act of 2022 mandates that all materials available in school libraries and classrooms undergo a regular review process. This process is especially pertinent when a recognized stakeholder brings forth concerns regarding any of the materials.
Should the bill become law, it will establish a process by which parents can enforce compliance with the Act.
