Require police to request ICE detainers, send undocumented immigrants out‑of‑state to sanctuary cities if not taken, and recoup costs.

AN ACT to amend Tennessee Code Annotated, Title 4; Title 7; Title 38; Title 39; Title 55 and Title 67, relative to illegal immigration.

TLRC statement

The proposed “Tennessee Illegal Immigration Act” mandates that law enforcement agencies request an immigration detainer from ICE for individuals known to be unlawfully present in the U.S. as soon as they take custody of them.

If an agency receives a detainer, it must keep the individual in custody until the specified time expires or until ICE takes them, whichever comes first. If no detainer is received, or if ICE has not taken the individual before the detainer’s expiration, the agency must transport the individual to a sanctuary city of their choice, up to 700 miles away.

Additionally, agencies must document the costs of custody and transportation and report these costs monthly to the Department of Revenue. The department will seek reimbursement from the U.S. Department of the Treasury and, if reimbursement is delayed, will withhold a portion of federal motor fuel taxes based on the reported costs to remit to the law enforcement agencies accordingly.
