Bill Description

AMENDMENT #1 adds that the government operations committee of the house of representatives or senate may request an agency to:
(1) Repromulgate a rule that has been in effect for eight or more years; or
(2) Repeal a rule deemed obsolete by one or both of the committees or the agency.
This amendment specifies that item (1) above applies to rules filed prior to or after the effective date of this bill. Under this amendment, any agency that is requested to repromulgate a rule must initiate the rulemaking process within 90 days of the request by the committee or be subject to item (2) above. If the agency fails to comply with the government operations committee's request to repromulgate a rule, the government operations committee of the house or senate may vote to request the general assembly to suspend any or all of the agency or related agency's rulemaking authority for any reasonable period of time or with respect to any subject matter, by legislative enactment.
This amendment also adds that all rules filed with the secretary of state on or after July 1, 2020, expire eight years from their effective date. This amendment changes this bill's effective date from "upon becoming law" to October 1, 2020".

TLRC Position

We support checks on unelected bureaucrats authority. This gives our elected representatives veto power over arbitrary rules. It gives the people the opportunity to lobby GA members for the repeal or repromulgation of discriminatory or unreasonable rules.
