HB0784/SB0516 Interim Senator to be elected by Gen. Assembly Littleton/Kelsey

Bill Description

When a sitting US Senator representing TN steps down or is incapacitated mid-term, this bill would transfer the appointing an interim Senator from the Governor to an election by the General Assembly. This would effectively reinstate article 1, section 3 of the Constitution, which was reordered by the 17th amendment, but only in these special circumstances when a replacement is necessary mid-term.

TLRC Position

TLRC supports this proposition. It brings the choice closer to the people and gives the appointee an advantage as an incumbent in the ensuing election.

TLRC Observed Process
