This bill aims to safeguard businesses and individuals from discrimination and privacy violations, particularly in the firearms sector. It prevents financial institutions from distinguishing firearms businesses with a specific merchant code, which could lead to the decline of lawful transactions.

The bill restricts financial entities from refusing transactions or disclosing financial records unless required by law, fraud controls, or customer request.

The attorney general is tasked with investigating violations and enforcing compliance. Violators may face injunctions and civil penalties up to $10,000 for non-compliance post-injunction, with considerations for the violator’s financial resources and potential harm to Second Amendment rights. The bill also allows for the recovery of investigative costs and attorney’s fees, and amends provisions for awarding damages to victims of information disclosure.

It grants individuals and entities a private right of action against financial institutions that violate these provisions.
